The long-awaited FY2023 omnibus appropriations bill has finally been released as the government attempts to push the bill through before the December 23 deadline. The bill contains a modest increase in funding for the EPA, but certain departments benefit significantly more from the bill than others. The bill amends the Federal Food Drugs and Cosmetics Act (FFDCA) concerning cosmetics with a new cosmetics regulation and two provisions concerning testing for talc and assessing the presence of per- and polyfluoroalkyl substances (PFAS) in cosmetics. It also amends requirements for pesticide registration and other regulatory amendments. This article will review these changes among others, dive into the appropriations surrounding the Environmental Protection Agency, and will compare current plans with the enacted FY2022 bill and the amounts initially requested.
