The Clean Water Act (CWA) was passed in 1972 and established the basic structure for regulating the discharges of pollutants into “ waters of the United States.” The CWA makes it unlawful to discharge any pollutant from a source into “navigable waters” unless the discharger receives a permit from the Environmental Protection Agency (EPA).
